Supermac’s Wins Major Case Against McDonald’s To Have Their Big Mac Trademark Cancelled

Supermac's has just won a long-running trademark battle against McDonald’s over the use of their brand names in Europe.

The ‘Big Mac’ and ‘Mc’ trademarks have been cancelled across Europe, effective immediately following a ruling by the European Union Property Office (EUIPO).

McDonald's had previously hit Supermac's with their own objection of the Irish brand’s expansion into Europe, arguing that their name and the ‘Big Mac’ trademark were too similar.

The EUIPO has ruled that McDonald’s have not proven genuine use of the ‘Big Mac’ trademark as a burger or a restaurant chain.

Supermac’s MD, Pat McDonagh said, "We knew when we took on this battle that it was a David versus Goliath scenario but just because McDonalds has deep pockets and we are relatively small in context doesn’t mean we weren’t going to fight our corner.

"The original objective of our application to cancel was to shine a light on the use of trademark bullying by this multinational to stifle competition.”
