It has been revealed that Irish pubs can legally offer takeaway and delivery services during lockdown after Gardaí sought clarity on the matter.
Good news if you've been missing your local as it turns out that a lack of clarity in liquor licensing laws means that pubs can legally operate takeaway or delivery services while the country is in lockdown.
Pubs (and their patrons) all around the country are rejoicing at the news that they will be able to operate takeaway and delivery services during lockdown, thanks to a "lack of clarity" in liquor licensing laws.
An article in the
Irish Times reports that pubs can once again deliver pints to their customers after Garda Headquarters sought legal advice on the matter. According to the findings, drinks - including poured pints - can be delivered to customers so long as they are paid for on a licensed premises. Takeaway sales will also be allowed, subject to customers consuming drinks/pints in private, a minimum of 100 metres away from the establishment.
According to the Irish Times, Gardaí received the following legal advice:
“Holders of on-licences may deliver intoxicating liquor to consumers for consumption in their private residences where the sale takes place at the licensed premises.
The law is unclear whether it is lawful for holders of on-licences to pour, prepare or decant intoxicating liquor at the delivery location, which is a public place. Therefore no offence is committed.”
The legal advice also adds that "persons may also attend the licensed premises and collect the intoxicating liquor purchased as a takeaway, and the same would be deemed a reasonable excuse”. However, Gardaí have the right to confiscate any drinks that they believe are being purchased to consume in a public place.
